Fiat dismisses former Polish union President for his criticism of management
On April 30th, 2009, Sadi FIAT Group management at Bielsko Biala, Poland, formally dismissed Mr. Rajmund Pollak, former union activist since the founding of Solidarnósc in 1980, on the pretext that his “position is discontinued”

The Polish FIAT plant, however, is at the moment working at full capacity due to high demand for the FIAT 500 and Panda and the Ford Ka models it produces.

Preceding his dismissal, on April 24th Mr. Pollak sent an open letter to FIAT worldwide management in Torino, criticising their decision to extend the regular working week to the Sunday night, while at the same time, FIAT has refused to increase the wages of the Polish workers. FIAT workers believe that the FIAT management did not appreciate Mr. Pollak’s criticism and that the argument of “discontinuation of his position” is only a pretext.

In a letter from Torino on April 17th to the trade unions and management at FIAT Poland, FIAT group Senior Vice President of Industrial Relations Mr. Paolo Rebaudengo explained that due to the economic crisis, wages of Polish workers would be frozen. At the same time however, the asked understanding for the fact that Polish FIAT workers would need to work 7 days per week in the nightshift. In his letter, Mr. Rebaudengo threatens to change FIAT’s investments policies for Poland if his orders are not being duly implemented.

FIAT Poland is one of the most profitable FIAT operation in the world. Productivity and quality at the production plant in Tychy are among the highest worldwide, while at the same time, wage levels are between 50-25% of those in Italy.

In his open letter of April 24th to Mr. Rebaudengo, Mr. Pollak demands equal treatment of FIAT workers in Poland and Italy. According to Mr.Pollak, right now Polish workers receive only half as much for a 7 days working week as their Italian colleagues receive for being laid off from work. As a first step, he proposes a minimal wage rise of 15-20% for Polish workers, to enable them to share modestly in the enormous profits they produce for FIAT and to decrease the huge wage difference towards their Italian colleagues.

Mr. Pollak also reminds FIAT management that already in the Middle Ages, Polish peasants possessed the right to a day off on Sunday. In fact, the Polish labour code stipulates a 40 hour week and even the Saturday is not considered to be a regular working day. This is one of the principal achievements of the struggle of Solidarnósc back in 1980-1981. The 3-shift system at FIAT Poland already includes the Saturday as a working day however, and now FIAT is forcing its Polish workers to work 7 nights at a row including the Sunday.

In Mr.Pollak’s view, he only exerted his right of free speech in criticising FIAT management, and now he is being victimised for defending the rights of his fellow workers. His dismissal stands alone, as in his office no other workers are being laid off for reorganisation or other economic causes. Mr.Pollak is a specialised automotive engineer and foreign commercial relations economic specialist who this summer would complete 30 years of service with the company, and there are plenty of other jobs he could perform inside the enterprise. However, no such jobs were offered to him.

It looks as if FIAT is using the pretext of the economic crisis to deteriorate the labour conditions and rights of its workers and to fire anyone who stands up against this and who defends the rights of his fellow workers. Mr.Pollak has been actively involved in the international union movement for the past 20 years.

Enclosed we send a draft protest letter to Mr. Rebaudengo. Please send a copy of your message by fax to the below address of the local press agency in the Krakov Region and to the press agencies in your country, as well as to Mr.Pollak.

We have been informed of the decision of the Sadi FIAT Group to fire long-time union activist at FIAT Poland, Mr. Rajmund Pollak, on the pretext that his “position is discontinued”. Mr.Pollak is a specialised automotive engineer and foreign commercial relations economic specialist, so there are many jobs he could perform inside your enterprise. It is unbelievable that no such jobs were offered to him. Mr.Pollak will shortly complete 30 years of service with your company.

On April 24th, 2009, Mr.Pollak has written to you about his objections to your order to freeze the wages of Polish workers while at the same time extending the working week at the Tychy production plant to the Sunday night. Mr. Pollak has reminded you of the huge wage difference between the FIAT workers in Poland and Italy, while at the same time FIAT Poland is contributing substantially to FIAT overall results. He proposed to reduce these wage differences.

We believe Mr.Pollak has only exercised his constitutional right of free speech and has in no way damaged company interests. His arguments appear valid and should be discussed in a proper way instead of him being sacked for defending the rights of his colleagues.

We urge you therefore to reconsider the dismissal of Mr. Pollak and to find another job for him that fits his workplace qualifications. We also urge you to take the necessary steps in order to secure proper negotiations in good faith with the Polish unions on their wages and working times.

We would appreciate to be informed about further steps from your side.

Resolution of CC of IMF in support od Ford Workers
Resolution of the Central Committee of the International Metal Workers’ Federation in support of Ford Workers in Vsevolozhsk, Russia

The Central Committee of the International Metalworkers’ Federation, which represents 25 million workers worldwide, during it meeting in Salvador, Bahia, Brazil on November 28-29, 2007, expresses serious concern about the deteriorating situation developing as a result of Ford management actions at the company's automotive assembly plant in Vsevolozhsk, Russia. Rather that engage the union in constructive and good faith negotiations over wages and working conditions, management has for months either refused to seriously consider proposals put forth by the union or has failed to meet with the union to continue meaningful negotiations. As a result, workers went on an indefinite strike starting on November 20, while calling on management to continue bargaining to reach a fair and mutually agreeable settlement.

The company’s decision to call in the special police forces last week at the outset of strike was an excessive and unnecessary act that can be seen as an attempt to intimidate workers. At the beginning of the strike, police blocked the entrance to the enterprise to prevent workers from entering the plant. Moreover, state police have been invited by company to patrol inside the plant premises. This is an unacceptable use of the state police force by private enterprise against workers exercising their fundamental right to strike. The company has moved further along a counterproductive path by attempting to resume production during the strike. There has already been a worker injured by the local police force on November 28. Another worker was seriously injured on the assembly line when management tried to resume production.

We support the struggle of Ford workers in Vsevolojsk to increase their wages and improve working condition, demand that the company cease any form of intimidation or force against workers, and call on management to promptly and in good faith enter into constructive negotiations with the union to reach a fair settlement.

Victory at Grob Brasil
Our brother Luis Batista Oliveira, Union director at machine-builder Grob Brasil, Sao Bernardo do Campo, arbitrarily fired at the beginning of August, had his job and Union post reinstated last Friday, the 21st of October.

After 72 days of struggle, during which he was camping in front of the plant, and with some strikes at the plant, lots of solidarity demonstrations, stoppage of Grob machines at DaimlerChrysler and Ford, intervention of the the Ministry of Labor, the Brazilian section of the ILO and the German embassy in Brasil, and hundreds of protest letters from around the world to the company in Brasil and in Germany, the respect for in-plant Union organization was finally restored.

On behalf of our Union and brother Luis Oliveira, I’d like to thank everybody that helped somehow with this major accomplishment for the Grob workers in Brasil.

International Worker Justice Campaign
Greetings Friends, Activists, Trade Unionists and Freedom Fighters

The IWJC was successful in convening seven (7) public hearings across the state from Rocky Mount to Charlotte over the past 12 months. More than 70 public service workers testified before distinguished panels of elected officials, ministers, and community leaders. More than 400 citizens and workers attended the hearings. This was the first phase of our struggle to win collective bargaining rights for public service workers in this state.

On November 1 - 3, 2005, the IWJC will host an international delegation of distinguished jurists from around the world who will investigate the conditions of public sector workers in North Carolina to see if this state's prohibition of collective bargaining rights for the public sector violates international law. The visiting jurists are members of the International Commission on Labor Rights (ICLR) and are well respected experts in their own countries.

Following the visit of this international delegation, UE will file a complaint against the state of North Carolina and the US for their alleged violations of international law with the ILO.

Ford Workers stopped Grob machine-tools in Taubaté
Yesterday we stopped production at some of the 30 Ford's Grob machine-tools in Taubate, Brasil, for 1,5 hour. With the stoppage dozens of other machines after those in the production sequence were unable to work, and the protest involved 400 out of the 1,500 workers at this plant that produces powertrain.

Machine-builder Grob fired a Union Director in early August. Brother Luis B. Oliveira decided then, with full support of the Union, to camp in front of the plant in Sao Bernardo, Brasil, ever since.

Last week some Grob machines were stopped at DaimlerChrysler in Sao Bernardo. Grob is a supplier of DaimlerChrysler in which International Framework Agreement (Social Responsibility Principles, signed with the World Employee Committee at DC and the International Metalworkers Federation, in 2002) is clearly established that every supplier should cope to the same principles, among them, the respect of Union organization.

Other actions will follow at other companies that have Grob machines untill the company negotiate the reinstatement of brother Luis Oliveira's job and Union position reestablishing the respect for in-plant Union organization.

Yesterday we stopped production at some of the 50 DaimlerChrysler's Grob machine-tools in Sao Bernardo Brasil, for 1 hour. Dozens of parts were unable to be produced.

The Machine-builder Grob fired a Union Director about 2 months ago. Brother Luis B. Oliveira decided, with full support of the Union, to camp in front of the plant in Sao Bernardo, Brasil, ever since.
